4/8/05—my DRE complaint about Infasource and Hyatt, CBSK, Bob Molnar, Archer Finance, Prime One

You can expect a junk faxer like Hyatt to lie and to commit perjury. 

The conduct of the DRE brokers sure is perplexing.  Is the DRE just another agency working to protect its members, the brokers?  Is that why Laura Archer (broker Archer Finance) and Todd Dalton (broker Prime One Financial) decided to simply ignore my suit?

CBSK, dba American Home Loans, apparently condones the illegal marketing.  My correspondence with their attorney Russell Grandy is posted at Fight Back!!!

Grandy is a liar, another scum sucking bottom feeding attorney.  I will never talk to him on the phone again unless I have his permission to record. 

We shall see what happens.  The long promised press release is next.  Wish I could triple the hours in my day.

To Whom It May Concern:

The above DRE licensees all engaged in unlawful mortgage advertising.  Attached are the junk faxes marked Exhibits D 1-5, sent out in violation of the TCPA by or on behalf of mortgage lead generator Keith Hyatt and his company Infasource.

All advertisements fail to comply with the California mortgage advertising regulations.

I filed my junk fax suit in Kingman, AZ, Superior Court, CIV–04-915. 

Keith Hyatt, owner Infasource, admits to the mortgage advertising in his sworn affidavit dated 3/14/05.

In addition to Hyatt’s false statements (perjury), claiming that I “registered” for his junk faxes, he clearly does not intend to stop the unlawful advertising.  I have reports from readers who continue to receive his mortgage junk faxes and California brokers pay over $60 for each lead according a recent Infasource invoice. It is an extremely profitable business.

Laura Archer, broker for Archer Finance, kindly identified Keith Hyatt as the junk faxer.  However, she also told me that she has no liability and that it is perfectly legal for DRE licensees to purchase these mortgage leads.  Your written opinion is appreciated.

Additionally, she apparently paid at least one unlicensed person identified only as “Moe” for loan origination as well as for the leads.  It appears that Moe was her connection to Hyatt and he was possibly also employed by Hyatt.  Ms. Archer failed to answer my Arizona complaint and she demanded that I not call her again.

Prime One Financial and Todd Dalton also received Hyatt’s junk fax leads.  While Mr. Dalton was served with my complaint and summons on 1/11/05, he did not respond at all.

CBSK (American Home Loans) and Bob Molnar also received Hyatt’s junk fax leads.  I was transferred to Molnar when I called on the junk fax and he was employed by CBSK.

CBSK attorney Russell Grandy informed me that Bob Molnar quit in January, apparently after CBSK was served with my complaint and summons.  According to Grandy, Molnar ordered the leads, although I have no evidence thereof.  CBSK apparently made no attempt to hold Molnar liable for my claims and apparently it did not conduct an investigation.

As I see no disciplinary action against Molnar at your website, I conclude that CBSK failed to report Molnar’s illegal marketing to the DRE.  CBSK has settled numerous TCPA violations, claims to be innocent and blames its agents.  However, CBSK apparently takes no action whatsoever against the faxers.  It does nothing to discourage its agents’ illegal marketing, such as reporting the agents to the DRE and holding the agents liable for the settlements.

Apparently the CBSK profits from the illegally obtained mortgage leads exceed the cost of the settlements.

I’ll appreciate your prompt investigation and disciplinary action against the licensees and a Cease & Desist Order against Keith Hyatt and Infasource, Inc.
